Legal textualism doesn’t allow attorneys or judges to make exceptions to a statute. This limits their power but increases the power of the legislature and public prosecutors. It increases the power of the legislature because lawmakers tend to favor harsh punishments, and it increases the power of the prosecutor and jury, as the only two ways for the defendant to avoid a harsh punishment for violating a statute is by negotiating a plea bargain or convincing the jury that the statute is unfair.
